Terms of Service

By accessing or using Nox AI ("Service") at noxaiapp.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.

Nox AI is an all-in-one AI creative studio that allows users to generate images, videos, voiceovers, music, talking avatars, stories and other creative content using third-party AI models (including FLUX, Kling, Veo, ElevenLabs, Ideogram and others). The Service includes editing tools, brand kit management, campaign organisation, and a social auto-posting feature.

Access to the Service requires a registered account. Some features require the purchase of credits or a subscription plan.

You must be at least 18 years old to create an account (or the age of majority in your jurisdiction, if higher). By registering, you represent that all information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@noxaiapp.com if you suspect unauthorised access.

Credits: Credits are the in-app currency used to pay for AI generations. Credits are consumed when you successfully generate content. Failed generations (due to AI provider errors) are refunded automatically.

Purchasing: Credits may be purchased as one-time packs or granted through a monthly/annual subscription plan. All purchases are processed by Stripe.

Non-refundable: Credits are non-refundable once consumed. Unused credit pack credits expire if your account is deleted. Subscription credits reset at each billing period and do not roll over.

Subscriptions: Monthly and annual subscriptions auto-renew. You may cancel at any time through the Billing Portal; cancellation takes effect at the end of the current paid period.

Price changes: We reserve the right to change pricing with at least 30 days' notice for existing subscribers.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Generate content that is illegal, defamatory, harassing, threatening or that promotes violence or discrimination.
• Generate non-consensual intimate imagery (NCII) or child sexual abuse material (CSAM). Violations will result in immediate account termination and may be reported to law enforcement.
• Impersonate any person or organisation, or use AI generation to create deceptive deepfakes of real individuals without their explicit consent.
• Attempt to reverse-engineer, scrape, or extract data from the Service in an unauthorised manner.
• Circumvent rate limits, credit deductions, or other access controls.
• Use the Service to generate spam, mass-produce misleading advertising, or run automated bulk generation without prior written consent.
• Violate the terms of service of any third-party AI provider whose models are used within Nox AI.

Your prompts & inputs: You retain any rights you have in the prompts and source materials you upload.

AI-generated outputs: To the extent permitted by law, outputs generated by the Service based on your prompts are assigned to you. However, AI-generated content may not be fully protectable by copyright in all jurisdictions — you are responsible for determining the intellectual property status of outputs in your jurisdiction before commercial use.

Nox AI content: All software, design, branding, marketing copy and non-generated content on the platform is owned by Nox AI and protected by intellectual property laws. You may not copy, reproduce or distribute it without written permission.

Licence to us: By uploading source materials (images, audio, video) you grant Nox AI a limited, non-exclusive licence to process those materials solely for the purpose of delivering the Service to you.

In addition to Section 5, you specifically must not generate or distribute through the Service:

• Content that infringes third-party copyrights, trademarks or other IP rights.
• Content that promotes terrorism, extremism or mass violence.
• Sexually explicit or adult content except where expressly enabled for your account (18+ age verification required).
• Medical, legal or financial advice presented as professional guidance.

The Service relies on third-party AI providers (FAL.ai, ElevenLabs, Anthropic, Google, ByteDance and others). Their terms of service and content policies also apply to your use of their models through Nox AI. We are not responsible for the availability, accuracy or output quality of third-party AI services.

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

AI-generated outputs may be inaccurate, offensive or unsuitable for your intended use. You are solely responsible for reviewing and determining the appropriateness of any AI-generated content before using or distributing it.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOX AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

We may suspend or terminate your account at any time, with or without notice, for violations of these Terms, suspected fraud, or at our sole discretion. You may delete your account at any time by contacting us.

Upon termination: your access to the Service ceases immediately; unused credits are forfeited (no refund for credits in active subscriptions except where required by law); any active subscriptions are cancelled effective end of the current period.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for IP infringement or breach of confidentiality obligations.

We reserve the right to modify these Terms at any time. For material changes we will provide at least 14 days' notice by email or by posting a notice on the Service. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
